HAWAI‘I LAND USE LAW RELATED TO CULTURAL RESOURCES

3-Credit REC Elective CE Course

This course will provide an overview of historical land tenure in Hawai‘i, historic legal analysis of the constitutionally protected traditional and customary rights of Native Hawaiians and how it impacts land ownership in Hawai‘i today. The course will cover State and federal laws related to the native Hawaiian burials, including how it affects land ownership in Hawai‘i and provide a summary of impact to development projects in Hawai‘i.

3-Credit REC Elective CE Course

The course will offer a local perspective into the unique aspects of land ownership in Hawai‘i and doing business in Hawai‘i. The course will provide an overview of key historic events from Pre-Western contact (pre-1778) to present day events including some of the contentious issues surrounding Mauna Kea. Many of these events have played a role in shaping some of our cultural, legal, and societal views in relationship to land ownership and doing business in Hawai‘i. Several of Hawai‘i’s land laws are unique only to Hawai‘i. The course also covers what’s unique about doing business in Hawai‘i, including comparing mainland business style vs. local style.
